Are you promoting your property in accordance with the decree 218/2005?
The purpose of the law is to protect the real estate consumer from being under-informed with regard to a real estate transaction.
Information Packs and property types
There are 2 types of information packs that must be available to "the consumer" depending on the type of property being marketed:
DIA (Documento Informativo Abreviado): This must be available from anyone promoting the sale of an off-plan (completed or under construction) property (also applicable to property in the state of undergoing major reformation works). A DIA must also be available to anyone interested in rental property. The information in the DIA will vary according to the type of property and relating factors.
Ficha Informativa: This must be given to anyone enquiring about a resale property. The information pack must include a recent Nota Simple as well as an IBI statement.
All property information packs must also include a detailed payment plan specifying the purchase price, costs, taxes and time frame.
Additionally, real estate professionals in Andalucia must display a notice in their place of business, in Spanish, in a clearly visible location, which states compliance with the new law. This must be displayed next to and in the same size as the notice as specified in decree 171/1989.
Any promotion or advertising of property (including window cards) must be presented at least in Spanish (additional languages are allowed as long as the Spanish is clearly presented) and detailing the information on the window display as specified in the new decree, except for advertising material created before the date of the decree.
