The Junta de Andalucía is still sending inspectors to real estate offices in the Andalucia region in an enthusiastic attempt to enforce the decreto 218/2005. Agents can be fined up to a staggering € 400000 for non-compliance with the ruling, which sets out a list of often ambiguous and complicated requirements for agents and developers to adhere to.
The lack of available information and severity of penalties have created quite a stir amongst real estate professionals, not only those whom have already been fined thousands of Euros for non-compliance with a ruling which many were quite genuinely unaware of.

The Junta de Andalucia has been fining agents for non-compliance with the decreto218/2005 of the 11th October more and more. 144 offices in the region have been visited in March and April alone, and when fines being doled out can reach a maximum of €400000, the situation is to be taken seriously.
The decree contains a list of rules that must be adhered to when marketing a property for sale or rental. For example, every property must be accompanied by an information pack called a DIA or FI, marketing material is subject to strict guidelines and every office must have various notices presented in a visible location.
Inspectors are consistently visiting offices across Andalucia, without warning. They do not have to reveal their identity and could even go as far as to view a property with an unsuspecting agent before handing over a fine for non-compliance with the decreto 218/2005. The severity of the situation has caused agencies in Andalucia to take down window cards, cease all advertising and in some cases even close their offices.
